£6,000 compensation for complications following substandard hernia surgery

A WOMAN who suffered immediate complications and needed further surgery following a substandard incisional hernia operation has received £6,000 in compensation.

Our client underwent hernia repair surgery at an NHS hospital in 2021, but saw the hernia reappear within 24 hours – a major indication that the initial operation had been poorly performed.

Following the incident, our clinical negligence specialists were instructed to investigate the case by obtaining her hospital and GP records.

Having referred the matter to an independent Consultant Surgeon, they concluded that the original hernia repair was negligently carried out.

Instead of using a mesh repair technique that was widely recognised for its lower risk of recurrence, a less effective method was chosen. The operation was performed by a relatively junior Specialist Registrar without involving a more experienced Consultant Surgeon, which the expert found to be inappropriate given the complexity of the procedure.

According to the expert, if the proper surgical technique and senior oversight had been applied, our client would likely have avoided a second surgery and the associated pain, anxiety and disruption to her life.

In December 2022, we submitted a formal Letter of Claim to the NHS Trust responsible, outlining the alleged negligence. They admitted the surgery had been performed negligently and that this failure had directly led to the recurrence of the hernia and need for further treatment.

Negotiations followed and, in early 2023, the ‘No Win, No Fee’ case settled for £6,000 without the need to go to court.
