Dental Negligence FAQs
What Is Dental Negligence?
Dental negligence is a broad term which relates to any type of injury directly caused, overlooked or made worse by a dentist of dental practitioner.
If you have experienced treatment where an error has been made, or if a delayed diagnosis has led to an injury, illness or further complications; you may be entitled to claim compensation.
If this sounds familiar to you, our Dental Negligence Solicitors could help you seek justice and secure the maximum possible damages.
What types of Dental Negligence are there?
If a dental practitioner or dentist causes harm or discomfort, there are two main types of Dental Negligence Claims you can make.
Misdiagnosis or Failure To Act Claims: The cause of a dental problem is not correctly identified and as a result an issue may not have been fixed or the problem may have escalated, potentially causing further damage to the teeth, gums or jaw.
Inadequate or Insufficient Dental Treatment Claims: Issues which arise when substandard techniques are used during treatment or a failure to recognise treatment is required, leading to further serious issues.
What are the most common examples of Dental Negligence Claims?
- Delayed or incorrect diagnosis – including oral cancer misdiagnosis
- Cosmetic dentistry problems – crowns, veneers, bridges, implants & whitening
- Poor treatment – no anaesthetic or pain relief, damage to crowns or veneers
- Periodontitis (gum disease) – Failure to diagnose or treat
- Failure to treat or diagnose decay, infection & tumours
- Treatment mistakes – leading to teeth loss or damage
- Orthodontic negligence – straightening & braces
- Root canal problems – failure to fully remove root
- Administering medication to which a patient is allergic
- Providing defective crowns, bridges or oral devices
- Allowing patient to swallow an instrument
- Tooth extractions – nerve and gum damage
- Failure to prevent tooth loss
- Removing the wrong tooth
- Permanently injuring a nerve
How long does a Dental Negligence Claim take?
To successfully pursue a dental negligence claim, you need patience and expert legal advice you can trust, as the complexity varies on a case-by-case basis. It could take less than 12 months. It might take years.
In our experience, most dental negligence claims are settled quickly. But the more complicated your case, the longer it usually takes. This often depends on the severity of your injury, the time required to gather all the necessary evidence, including reports from independent dental experts, and the willingness of the dentist to accept liability for your pain and suffering.
To minimise the stress caused by the legal process, we can provide immediate representation, offering expert support and advice throughout the entire case.
Are there any time limits for making a Dental Negligence Claim?
In most cases, a dental negligence claim needs to be made within three years of the time when you first realised you may have received negligent treatment.
If three years have passed, you won’t be able to pursue a case. But there are some exceptions to this dental negligence time limit.
There is no time limit when claiming compensation on behalf of a child. When they turn 18, the three-year rule applies.
If someone does not have the mental capacity to claim for themselves and you are claiming on their behalf, there is no time limit.
If you’re not sure whether you qualify to make a claim, get in touch or call 0191 5666 500 and discuss your case with our Dental Negligence Solicitors.
