What are the time limits for making a claim?
In most cancer misdiagnosis claims, you usually have three years to start your case from the date when you are first aware that mistakes have been made.
However, we would advise starting your claim as soon as possible as there are some notable exceptions to this rule.
Claiming for someone who has died: To claim for a family member who has passed away, the three-year time limit starts from the date of death or the date when you were first aware of the negligence, whichever is the latest.
Child claims: If a child has suffered from a cancer misdiagnosis, a claim can be made at any point until the day of their 21st birthday.
Mental capacity: When someone lacks mental capacity, there is no time limit for making a claim. If they were to regain mental capacity, the normal three-year limit would apply.
